Terms and Conditions for Vendors

1. Introduction

Welcome to Find-MyParts (“Find-MyParts”). By registering as a vendor (“Vendor”) on our platform (“Platform”), you agree to be bound by these Terms and Conditions (“Agreement”). Please read them carefully before proceeding.

2. Vendor Eligibility

2.1. To become a Vendor, you must be at least 18 years old and legally authorized to enter into binding agreements.
2.2. You must provide accurate, current, and complete information during the registration process and keep this information updated.
2.3. Find-MyParts reserves the right to refuse registration to, or terminate the account of, any Vendor at its sole discretion, subject to applicable law.

3. Commission and Fees

3.1. Find-MyParts charges a commission on the total sale price of each product sold through the Platform. The commission consists of:
* A base commission of 10%.
* A service fee of USD 10.00.
3.2. An additional commission of 5% will be applied to cover bank transfer and credit card payments for processing fees.
3.3. The total commission deducted from each sale will be 10% plus a USD 10.00 Service Fee.
3.4. Commissions are non-negotiable and will be automatically deducted from your sales revenue.
3.5. Find-MyParts reserves the right to modify the commission structure with 7 days’ written notice to Vendors. Notice will be provided via email and platform notification.

4. Payment Terms

4.1. Payments to Vendors will be processed on a (weekly) basis, according to the Platform’s payment schedule. The specific payment schedule will be available on the Platform.
4.2. Payments will be made via bank transfer or other mutually agreed-upon electronic payment method.
4.3. Find-MyParts is not responsible for any fees charged by banks, payment processors (e.g., Swipe, PayTr, PayPal), or other financial institutions. These fees are the sole responsibility of the Vendor.
4.4. Vendors are responsible for providing accurate and up-to-date payment details. Find-MyParts is not liable for delays or errors in payments caused by incorrect or outdated information provided by the Vendor.

5. Product Listings, Pricing, and Prohibited Products

5.1. Vendors are solely responsible for the accuracy, quality, legality, and safety of all products they list on the Platform.
5.2. All products must comply with all applicable laws, regulations, and industry standards, including but not limited to safety regulations, labeling requirements, and import/export restrictions.
5.3. Vendors must set competitive and fair prices for their products. Find-MyParts reserves the right to remove listings that violate reasonable pricing policies or are suspected of price gouging.
5.4. Prohibited Products: The following products are strictly prohibited from being listed or sold on Find-MyParts:

• Counterfeit or replica products
• Books from publishers banned by the Ministry of National Education
• Products requiring government authorization for sale
• Firearms and knives
• Military equipment
• Live animals
• Stolen goods or products with removed serial numbers
• Listening devices
• Stocks, bonds, and securities
• Human organs
• Smuggled or illegally imported products
• Pirated and unlicensed products
• Cultural and natural heritage items
• Lock picks and lock-opening tools
• Pornographic materials
• Radar detectors
• Prescription drugs, contact lenses, and products with medical indications
• Official uniforms and clothing
• Lottery and gambling tickets
• Bulk email address lists
• TV decoders and encrypted broadcast decryption devices
• Tobacco products & electronic cigarettes
• Narcotics and drug-related paraphernalia
• Tester perfumes
• Listings that do not qualify as actual products
• Flammable and explosive materials
• Banned publications
• Veterinary medical products
• Second-hand or used underwear and socks
• Chemical products like pepper spray
• Any products whose sale is legally prohibited

Products that may cause legal violations:

• Contracts
• Copyrighted products
• Facial photos, names, and signatures
• Games (Unlicensed games less than five years old)
• Software (Unlicensed software)

5.5. Find-MyParts reserves the right to remove any product listing that it deems to be in violation of these Terms and Conditions or any applicable law or regulation. Find-MyParts may also suspend or terminate a Vendor’s account for repeated violations.

6. Order Fulfillment and Shipping

6.1. Vendors are responsible for fulfilling orders promptly (within 5-7 business days, unless otherwise specified in the product listing) and providing accurate shipping information to customers.
6.2. Vendors must use reliable shipping methods and provide tracking information to customers.
6.3. Delays in shipping or failure to fulfill orders may result in penalties, including warnings, account suspension, or termination.
6.4. Vendors must handle customer inquiries and complaints related to their products and orders in a timely, professional, and courteous manner.
6.5. Vendors are responsible for all shipping costs, unless otherwise agreed upon with the customer.

7. Returns and Refunds

7.1. Vendors must comply with Find-MyParts’s Return and Refund Policy, which is incorporated into this Agreement by reference and available https://www.find-myparts.com/return-and-refund-policy/.
7.2. If a customer requests a return or refund that complies with the Return and Refund Policy, the Vendor is responsible for processing the return/refund within 14 business days. Find-MyParts’s commission will be deducted from the refund amount.
7.3. Find-MyParts reserves the right to mediate disputes between Vendors and customers regarding returns and refunds. Find-MyParts’s decision in such disputes is final and binding.

8. Intellectual Property

8.1. Vendors warrant that they have the legal right to sell the products listed on the Platform and that the products do not infringe upon the intellectual property rights (including copyright, trademark, and patent rights) of any third party.
8.2. Find-MyParts is not liable for any intellectual property infringement claims arising from a Vendor’s products. The Vendor agrees to indemnify and hold Find-MyParts harmless from any such claims.
8.3. Vendors grant Find-MyParts a non-exclusive, worldwide, royalty-free license to use their product images, descriptions, trademarks, and other content for promotional purposes on the Platform and in marketing materials.

9. Termination

9.1. Either party may terminate this Agreement at any time with [Number] days’ written notice to the other party.
9.2. Find-MyParts reserves the right to immediately suspend or terminate a Vendor’s account for violations of these Terms and Conditions, suspected fraud, or any other reason at its sole discretion, subject to applicable law.
9.3. Upon termination, the Vendor must remove all product listings from the Platform. Any outstanding payments owed to the Vendor will be processed according to the payment schedule, less any applicable commissions or fees. Any outstanding payments owed by the Vendor to Find-MyParts will become immediately due and payable.

10. Limitation of Liability

10.1. To the maximum extent permitted by applicable law, Find-MyParts is not liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, lost profits, lost data, or business interruption) arising from the use of the Platform or the sale of products through the Platform.
10.2. Find-MyParts’s total liability to any Vendor shall not exceed the total commissions paid to Find-MyParts by the Vendor in the six (6) months preceding the date the claim arose.

11. Amendments

11.1. Find-MyParts reserves the right to modify these Terms and Conditions at any time.
11.2. Vendors will be notified of any material changes to these Terms and Conditions via email and Platform notification at least 7 days prior to the effective date of the changes. Continued use of the Platform after the effective date of the changes constitutes acceptance of the updated Terms and Conditions. If the Vendor does not agree to the changes, they must terminate their account.

12. Governing Law and Dispute Resolution

12.1. This Agreement shall be governed by and construed in accordance with the laws of Turkiye/Ankara.
12.2. Any disputes arising from this Agreement shall be resolved through the laws of Turkiye/Ankara.

Acknowledgment

By registering as a Vendor on Find-MyParts, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. You further represent and warrant that you have the authority to enter into this Agreement on behalf of yourself or the business you represent.
